These terms and conditions ("Terms") govern the use of the buddypetfoods.co.uk website ("Website") and your relationship with:

("we", "our", "Buddy", or "us"). Please read these Terms carefully as they affect your rights and liabilities under the law. If you do not agree to these Terms, please do not use the Website. Also, read our Privacy Policy.

1. AGREEMENT

By using the Website, you agree to be bound by these Terms. Only individuals who are at least 18 years of age and legally capable of entering into binding contracts may use the Website and enter into agreements with us.

2. REGISTRATION

By using this Website, you warrant that; your personal details which you are required to provide when you register are true, accurate, current, and complete in all respects, and you will not impersonate any other person or entity.

Products purchased on this site are for personal use and not for commercial use. If your personal details change, you should immediately notify customer service.

3. PRIVACY POLICY

We will treat all personal information you provide as confidential and will only use it in accordance with our Privacy Policy.

4. ORDERING

All orders from you are treated as an offer to purchase goods or services from us and we have the right to reject such offers. You will receive an automatic email confirmation of your order, but it does not guarantee our acceptance of your purchase of goods or services on our website.

A contract between you and us will be formed when we (i) charge your credit card, debit card, PayPal account, or other payment method, or (ii) dispatch the goods to you or commence the services. If the latter occurs, we will send an email confirming that goods have been dispatched and/or the contract has been entered into. The contract will only pertain to those goods or services whose dispatch we have confirmed by email.

The responsibility for the products passes to you/the customer once they have been delivered to the delivery address you specified when ordering the products. We take no responsibility if you provide an incorrect delivery address or if you fail to collect the products from the delivery address you specified.

5. PRICE & PAYMENT

All prices shown on the website include VAT. We reserve the right to modify prices at any time without notice (changes do not apply to orders for which you have received an order confirmation). For discounts, a maximum of 15 kg of dry food may be purchased per household.

We offer payment via Shopify's checkout and offer debit and credit cards (Visa, MasterCard, American Express), mobile pay and PayPal accounts. For subscriptions, the amount is charged monthly, according to the intervals chosen by the customer. Our card payment solutions are 3D Secure certified (verified by Visa and MasterCard SecureCode) and comply with PCI DSS standards.

6. DELIVERY

We deliver our products and services throughout the UK, usually dispatching your order within 24 hours on weekdays, with a normal delivery time of 1-3 days (depending on delivery options in your area). We use a number of different transport companies. In our range, there may also be products on order, which may have separate delivery conditions, as they are not stocked as regular inventory.

We offer free shipping on all orders over £40; for purchases under £40, a shipping fee applies depending on the delivery option. For more info, please see our shipping policy.

If we are unable to deliver your order within the agreed time, you will be informed of a new delivery time. You then have the right to cancel the purchase at no cost if the delivery time has been of significant importance. This also applies to special orders. Note that delivery times may be longer than usual during the Christmas and New Year period as well as Black Week.

7. TASTE GUARANTEE

We at Buddy have strong confidence in our feed and believe in honesty. Therefore, we offer a taste guarantee on all our dog foods. The taste guarantee can be utilized after the first order if your dog, against all odds, does not like the feed.

To use our taste guarantee, at least 80% of the content must remain in the package and the feed must be returned within 30 days from the day you received the delivery. When utilizing the taste guarantee, you as the customer pay the return shipping to us. To use the taste guarantee, email us at hello@buddypetfoods.com.

8. RIGHT OF CANCELLATION & REFUND

Normally, consumers have a 14-day right of cancellation, but we have chosen to offer 30 days. This means that you as a customer have the right to cancel and return your purchase within 30 days after you have received your first order.

As a customer, you have the right to return even if the packaging is broken. However, we reserve the right to make a possible deduction from the refund amount corresponding to the value by which the value of the goods has decreased due to (i) the goods being handled more than what is allowed by law (i.e., the goods can no longer be considered unused/undamaged) and/or (ii) the packaging has incurred greater damage than what was necessary when opening the package. Depreciation deductions can be made up to 100% of the value of the goods. We cover any shipping damages.

The refund will be processed through Klarna.

If you return an item to us according to your right of cancellation, we will carry out a refund on the day the item is returned to Buddy's warehouse, or other proof that the item has been sent back is presented. You as the consumer are responsible for the return shipping for all types of returns, including returns of large orders and parts of an order. The shipping cost for larger returns can be up to approximately £15.

9. COMPLAINTS

We follow the applicable rules in the Consumer Sales Act (1990:932). This means that you have the right to complain about a product provided that the product was faulty at the time of delivery and that you notify us of this within a reasonable time after you noticed or should have noticed the fault in the product.

Contact us and tell us why you are not satisfied and we will send a return label. The quickest handling of your case is obtained by contacting us by email, chat, or phone, but you can also present your complaint in writing by letter to Petbuddy AB, 559153-5025, POSTBOX 11104 Kocksgatan 15, 100 61 Stockholm.

In cases where the product needs to be returned, you are responsible for the transport risk. No examination fee applies, even if we judge that the complaint is not justified. If you want the product sent back after a possible rejected complaint, you pay for the shipping cost.

The right to complain ceases by law three years after the customer has received the product or when the expiration date has passed. Point out any defects within a reasonable time. In the event of disputes that we cannot resolve together, we recommend that you turn to the General Complaints Board or to the EU Commission's ODR platform. We always follow their recommendations. 10. COMPETITIONS

We reserve the right to change the rules of any competition.

The rules apply to each competition unless otherwise stated in the competition instructions. By participating in competitions, entrants agree to these rules and to abide by them.

Employees of PETBUDDY LTD or their immediate family members are not eligible to participate in competitions. Competitions are only open to residents of the UK. All participants must be at least 18 years old. Participants under 18 must have parental consent to participate in the competition.

Participants must register before the competition closes and all entries must be submitted before the competition ends. We take no responsibility for material sent to the wrong address, lost due to technical problems, or for any other reason received late. We reserve the right to disqualify participants if we suspect cheating or fraud.

Participants bear their own costs for computer and internet use and the means required to participate in competitions. All competitions that we promote are bound by these competition rules unless otherwise stated.

11. REVIEWS & IMAGES

When you submit a review about us, you grant us a non-exclusive, royalty-free, perpetual, irrevocable right to use, reproduce, modify, publish, translate, and use in conjunction with other materials, transmit, display such material and content in all media channels.

You grant us permission to use the name that you provide in connection with your review. You agree to waive the right to be identified as the author of such material. You warrant that at the time of publishing or when you submit material, you own or otherwise control all rights to the material.

Further, the content and materials published or submitted should not violate our guidelines or cause damage to individuals. The material and its content should not be defamatory and you agree to indemnify us for any third-party claims made against us caused by your failure to follow these rules and regulations.

12. FREE GIFTS AND MULTIPRODUCT OFFERS

13.1 When we offer a gift with a product, we only give away one gift per purchase (regardless of how many items you buy). The free gift is subject to availability and we reserve the right to replace the free gift with an alternative gift. To be able to have an offer with a gift, it may sometimes be necessary for us to set a symbolic value on the gift. If you return an order that was the basis for your free gift, we have the right to request that you also return the gift.

13.2 This offer is only valid for selected items that are in the multiproduct section on our website. If you return an item (with the exception of exchanges for broken or damaged items), we reserve the right to either request that all items included in the multiproduct offer be returned or that you pay the full price (as stated on this website) for the items you keep.

13. NEWSLETTER

By registering as a customer, you consent to receive our newsletter. If you wish to unsubscribe, you can do this easily by clicking on the link at the bottom of the email.

14. ERRORS & PRODUCT INFORMATION

In the event of inaccuracies in price or stock status, we reserve the right to cancel a purchase agreement. If the item has been discontinued or for any other reason is not available, we are not obligated to provide the item but may suggest an alternative product.

15. INTELLECTUAL PROPERTY RIGHTS

16.1 We or our licensors own all intellectual property rights to the Website and all material published on the website. These works are protected by copyright and all such rights are reserved.

16.2 You may print a copy and download extracts of any page(s) from the Website for your personal use and you may draw the attention of others within your organization to content posted on our site. However, you must not use any part of the content on our site for commercial purposes without obtaining a license to do so from us or our licensors.

16.3 By subscribing, you give us an irrevocable right to quote you from the comments regarding us, the products, or the subscriptions that you leave on our website, blog, or social media. We reserve the right to use the quotes on our site, on social media, and in other marketing.

16. CORRECTIONS & UPDATES

We reserve the right to update these terms and any changes will be communicated to you via a notice on the website. It is your responsibility to check if such changes have been notified. Changes will apply to the website after we have posted such a notice.

If you do not wish to accept the new terms, you should not continue to use the website. If you continue to use the website after the date on which the change comes into effect, your use of the website indicates that you agree to be bound by the new terms. We reserve the right to change or withdraw, temporarily or permanently, this website and the material therein (or any part) without notifying you, and you confirm that we shall not be liable to you for any modification or discontinuance of the website or its content.

17. WE PROTECT YOUR SECURITY

To ensure that your credit, bank, or payment card is not used without your consent, we will validate name, address, and other personal information supplied by you during the order process against appropriate third-party databases.

We take online fraud very seriously. With the increased number of fraudulent credit card transactions, we do everything to ensure that all orders are thoroughly checked using the information already provided. There is a possibility that we may contact you to make further security checks and we ask for your cooperation to enable us to complete them. We will not tolerate fraudulent transactions and such transactions will be reported to the relevant authorities.

By accepting these terms, you consent to such checks being made. In performing these checks personal information provided by you may be disclosed to a registered credit reference agency which may keep a record of that information.

18. FORCE MAJEURE

If the performance of our obligations is substantially hindered or prevented due to circumstances beyond our control, such as labor disputes, fire, lightning, terrorist attack, altered legislation, governmental intervention, errors or delays in services from subcontractors due to the circumstances stated here, this shall constitute a ground for relief. This results in the postponement of the time for performance and exemption from damages and other penalties. However, this shall not limit your rights under consumer sales law or other mandatory legislation.

The Website may contain links to websites operated by one of our partners, advertisers, or by another third party. Please note that we are not responsible for the content on these websites or for the goods or services offered there.

20. INVALIDITY

If any part of these terms is determined to be illegal, invalid, or otherwise unenforceable, then the enforceability of the remaining parts of the terms will not be affected.

21. ENTIRE AGREEMENT

These terms constitute the entire basis of any agreement between you and us.

22. LAW AND JURISDICTION

Any disputes should primarily be resolved in agreement after discussion with our customer service. In case of a dispute, we follow the decisions from the General Complaints Board. Disputes concerning the interpretation or application of these terms shall be interpreted in accordance with UK law and shall be resolved by the General Complaints Board or ultimately by a general court, whereby the Courts of England shall be the first instance.
